Ohio SB 306 Eliminating Assignment of Benefits Moves to House

Ohio Senate Bill 306 (SB 306) has passed the Ohio Senate and is now moving through the Ohio House. If enacted as written, this bill, the Auto Care Association (ACA) states, would deal a "serious blow" to independent repair facilities across the Buckeye State.

Key provisions of SB 306 would:

  • Eliminate the assignment of insurance claims to third parties, removing shops' primary tool for disputing unfair insurer estimates
  • Freeze shop storage fees before a total-loss determination is formalized
  • Extend the window insurers have to tie up disputed vehicles
  • Require shops to grant insurers immediate access to their facilities with no advance notice and no protections if damage occurs

Violations would carry mandatory fines, and dealerships are exempt from all of the above.
